I have an idea….now what???
To start the process, a search must be performed. Although
many people come and say I already searched, it’s not patented, this is often a premature assessment.
After
the search, the application is drafted, and all related forms are assembled and filed with The United States Patent and Trademark
Office.
This is not the end…it is the beginning!
The patent then must be prosecuted according
to the current standards and practice of the US Patent Office. The patent examiners are very thorough and can reject applications
for a variety of reasons.
The process of responding to any issues raised by a patent examiner is called patent
prosecution. Once the issues are addressed to the satisfaction of the examiner, the application issues as a valid United States
Patent.
